Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Audienceflow website and its services (the "Service") operated by Raven Consulting ("us," "we," or "our"). Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Service.

1. Definitions

  • Service: Refers to the Audienceflow tool, website, and all associated functionalities, including the ability to identify potential leads from Instagram accounts by grouping followers into audiences.
  • User/You: Refers to any individual or entity accessing or using the Service.
  • Account: Refers to a unique account created for you to access our Service.
  • Content: Refers to any data, text, graphics, images, or other material uploaded, downloaded, or appearing on the Service.
  • Instagram Data: Refers to information obtained from Instagram, including but not limited to public follower lists, profiles, and engagement data, processed by the Audienceflow Service.

2. Service Description

Audienceflow is a tool designed to assist businesses in identifying and segmenting potential leads from designated Instagram accounts. The Service processes publicly available Instagram follower data to group individuals into various audience categories, providing insights for targeted marketing efforts. Audienceflow acts as a data analysis and organization tool and does not engage in direct marketing or communication on your behalf.

3. User Accounts

When you create an account with us, you guarantee that you are above the age of 18 and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the immediate termination of your account on the Service.

You are responsible for maintaining the confidentiality of your account and password, including but not limited to the restriction of access to your computer and/or account. You agree to accept responsibility for any activities or actions that occur under your account and/or password. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar, or obscene.

4. User Responsibilities

As a user of Audienceflow, you agree to:

  • Comply with all applicable laws and regulations, including but not limited to data privacy laws (e.g., GDPR, CCPA) and Instagram's Terms of Use.
  • Ensure that you have the necessary rights and permissions to process any Instagram data you submit to or analyze with the Service.
  • Use the data obtained from Audienceflow solely for legitimate business purposes, such as market research, audience segmentation, and lead generation, and not for any unauthorized or illegal activities.
  • Respect the privacy of individuals whose data you analyze and avoid any actions that could be considered spamming, harassment, or unlawful targeting.
  • Take full responsibility for your marketing and communication activities based on insights gained from Audienceflow.

5. Prohibited Uses

You may use the Service only for lawful purposes and per these Terms. You agree not to use the Service:

  • In any way that violates any applicable national or international law or regulation.
  • To exploit, harm, or attempt to exploit or harm minors in any way by exposing them to inappropriate content or otherwise.
  • To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation.
  • To impersonate or attempt to impersonate Raven Consulting, a Raven Consulting employee, another user, or any other person or entity.
  • In any way that infringes upon the rights of others, or in any way is illegal, threatening, fraudulent, or harmful, or in connection with any unlawful, illegal, fraudulent, or harmful purpose or activity.
  • To engage in any other conduct that restricts or inhibits anyone's use and enjoyment of the Service, or which, as determined by us, may harm or offend Raven Consulting or users of the Service, or expose them to liability.

Additionally, you agree not to:

  • Use the Service in any manner that could disable, overburden, damage, or impair the Service or interfere with any other party's use of the Service, including their ability to engage in real-time activities through the Service.
  • Use any robot, spider, or other automatic device, process, or means to access the Service for any purpose, including monitoring or copying any of the material on the Service.
  • Use any manual process to monitor or copy any of the material on the Service or for any other unauthorized purpose without our prior written consent.
  • Use any device, software, or routine that interferes with the proper working of the Service.
  • Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful.
  • Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Service, the server on which the Service is stored, or any server, computer, or database connected to the Service.
  • Attack the Service via a denial-of-service attack or a distributed denial-of-service attack.
  • Take any action that may damage or falsify the Audienceflow rating.
  • Otherwise, attempt to interfere with the proper working of the Service.

6. Order Processing

Our order process is conducted by our online reseller, Paddle.com. Paddle.com is the Merchant of Record for all our orders. As a result, Paddle will be seen in all payments on our behalf. Paddle provides all customer service inquiries and handles returns.

7. Refund Policy

Due to the immediate and irreversible nature of the results provided by our Service upon order completion and content download, we generally do not offer refunds for services already rendered. However, unused credits purchased for future use of the Service may be eligible for a refund. To request a refund for unused credits, please contact our customer service team via support@ravenconsulting.tech or support within 30 days of the purchase date. All decisions regarding refunds for unused credits are at our sole discretion.

8. Intellectual Property

The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Raven Consulting and its licensors. The Service is protected by copyright, trademark, and other laws of both Nigeria and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Raven Consulting.

9. Disclaimers

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THE SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

Raven Consulting, its subsidiaries, affiliates, and its licensors do not warrant that:

  • The Service will function uninterrupted, securely, or available at any particular time or location.
  • Any errors or defects will be corrected.
  • The Service is free of viruses or other harmful components.
  • The results of using the Service will meet your requirements.

10. Limitation of Liability

IN NO EVENT SHALL RAVEN CONSULTING, NOR ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

13. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice before any new terms take effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Service.
